Nelson Arias-Alvarez is a Partner in the Construction & Infrastructure division of Madison Marcus Law Firm. Nelson has an extensive general commercial litigation background and significant expertise in building, construction and infrastructure litigation.
Nelson’s general litigation experience includes corporate insolvency, bankruptcy, professional negligence, competition law, trade practices, corporations and significant property, equity and trusts litigation.
Nelson’s experience in front end building and construction includes expertise in relation to site acquisition, development approval process, funding, contractor procurement and tenders, contract management and project delivery. His relevant litigation experience includes disputes concerning timing, programming, variations, contract management, defects and negligence claims.
Nelson also has infrastructure experience, including most recently successfully acting for a major Western Sydney council in relation to a dispute concerning road upgrades to the Cumberland Highway.
Nelson has acted for local governments and corporate clients including developers, engineers, project managers and architects.
In matters involving litigation, Nelson aims to design a flexible strategy which seeks to avoid court proceedings and resolve disputes as early as possible. He does this through an early identification of commercial objectives, due diligence on the viability of litigation and consideration of appropriate dispute resolution options. Where court proceedings are necessary, Nelson’s strategy is for fast, cost effective and efficient proceedings.
Nelson has experience in Federal and State Courts including the Supreme Courts of New South Wales, Queensland and Victoria as well as Federal and State tribunals (NCAT).
In addition to his role as Partner at Madison Marcus, Nelson is a current Lecturer in Law at Western Sydney University. Nelson has lectured in commercial law, property law, equity and trusts, alternative dispute resolution, planning and environment law and administrative law. He is currently completing a Diploma of Building and Construction (Management).
